Terms of Use
By creating a your profile at www.sportstrom.com (Sportstrom) and marking the checkbox next to the text “I accept the terms of use” referring to this document - and which is necessary to complete a Sportstrom profile registration, you are accepting and agreeing with the terms of use described herein:
1. Age limit
You represent and warrant that if you are under 18 years of age you have your guardians approval to register at Sportstrom and use its portfolio of services prior to registering your profile.
2. General
You agree NOT to use any of Sportstrom’s content or functions for any other purposes that what is explicitly expressed in these terms of use document.
You also agree NOT to alter, try to alter, or in anyway influence or affect the functions related to security and/or protection of data, content, and/or user information at Sportstrom.
Sportstrom does NOT guarantee any performance or availability of information posted or entered in any way onto Sportstrom and does NOT in any way reimburse or assume liability for any loss of data saved on Sportstrom, regardless of the cause of such loss of data. All information you upload and save on Sportstrom is at your own risk. Sportstrom recommends that you always keep your own back-up storage of all information saved at Sportstrom.
Sporstrom reserves the right to upon Sportstrom’s sole discretion request that updated and newer versions of these terms may have to be approved by you in order for you to have continued access and maintain your own profile at Sportstrom - despite the fact that your profile may have been created and published previously under different terms of use.
3. Responsibility for the Content on Your Profile Page(s)
Sportstrom does not assume any responsibility and/or ownership of the content you publish on Sportstrom and/or your profile page(s). You agree and accept that you are fully responsible for all content you upload and publish as well as all messages and reviews you send to other members. Content that you are responsible includes, but is not limited to: text, pictures, video, vide clips, messages, reviews, press clips, url’s to other sites, grades and comments of other members content, and all interaction you may perform with other members. Furthermore you represent and warrant that you will ensure that all such said content will comply with applicable laws (including copyright laws) as well as the terms of use described herein.
In the event that a third part should decide to pursue legal action against Sportstrom because of the content that you have published on Sportstrom, you agree to assume full responsibility of such claim and indemnify Sportstrom against any claim, legal proceedings, and possible agreed damages as a result of the content you have published.
Sportstrom recommends that you use anonymous information in your published profile and that you avoid any information that can be used by other Sportstrom visitors to determine the identity of yourself. However, this does not in any way limit your aforementioned responsibility to comply with laws and terms of use for all activities you engage in on Sportstrom.
4. Rules
4.1 You are allowed to:
Create and publish unlimited number of profiles on Sportstrom, provided that if you are under 18 you have your guardian’s approval prior to registration at Sportstrom.
Publish non offending text, numbers, messages and ideeas that you think are relevant to promote a positive (non offending) profile/image of yourself.
Upload and publish non offending pictures, videos, video clips, press clips, reviews, profile name, alias, provided that that content is legal and you have the legal permission to publish that content (this includes but is not limited to copyrights and other persons approval if they are in any way visible in your content)
Send suitable, non offending, and legal messages and reviews to other members.
Use the rating system to rate content that other members have uploaded and published under their profiles.
4.2 You are NOT allowed to:
Upload any form of content, such as but not limited to: text, numbers, links, pictures, videos, video clips, articles, press clips, references, messages to other members, reviews, titles, alias, that
A) are illegal according to International and/or Swedish law
or
B) for which you don’t have the copyright or license to use/show under your profile (The management behind Sportstrom would like to pinpoint that content containing sport is often regulated by strict copyright laws and licenses)
or
C) in any way is offending, unsuitable, or inappropriate.
Sportstrom reserves the right to at its sole discretion determine what is considered offending, unsuitable, and/or inappropriate. For the sake of clarity offending, unsuitable, and/or inappropriate content includes but is not limited to pornography, strong political opinions or references, insults, harassments, promotion of drugs and/or alcohol, agitation against an ethnic group, promotion of criminal behavior or reference thereto, bully, or in any way wicked comments or content.
In any way try to alter or influence the functionality and/or security levels offered by Sportstrom. You are NOT allowed to perform or try to perform any sort of data intrusion and you may NOT try to access or alter any underlying program code, database structure, security configuration, or any other site infrastructure.
Use Sportstrom for any commercial purposes, messaging or means for contacting others via such as but not limited to junk mail, spam, and/or chain letters
Use, copy, and distribute other members content without their prior written consent
Login or attempt to login on other members profiles without their prior written consent.
4.3 You are aware and accept that:
In the event that the management team of Sportstrom is made aware that you have broken any of the rules above or do not comply with the terms set forth in this document, your profile will be decommissioned and Sportstrom will if applicable and when possible pursue legal action against you (including filing reports to the police authorities when possible). In the event that a user should upload content containing or in any way referring to child pornography, pedophilic behavior (stavas det så?), or data intrusion, Sportstrom will assign proactive (research) resources to support applicable law enforcement body(ies) to facilitate that proper action is taken against such individual.
You are aware and accept that the management team of Sportstrom may at its sole discretion and without any need for justification decommission any profile and its content that the Management of Sportstrom deems to be inappropriate.
5. Re-Publishing of your content
Sportstrom does not have any claims or rights to your content and you remain responsible and owner to your content. However, Sportstrom intend to publish dedicated pages and lists with “best”, “highest rates”, “famous”, and other special categories defined by the Sportstrom management team (as well as your own profile page). You therefore hereby grant Sportstrom a limited royalty-free license to use, modify, re-publish, and publicly display such content through the Sportstrom site. You also represent and warrant that you have the right to grant Sportstrom this said license.
6. Sportstrom's role
Sportstrom does not assume any responsibility for the content you or anyone else post/publish on Sportstrom, and it is your responsibility to ensure you follow the terms laid out in this document.
Sportstrom does not guarantee any reliability and availability of the services and content you or anyone else post on Sportstrom. All data stored on Sportstrom by yourself is on your own risk and under no circumstances do you have any rights to request any sorts of damanges from Sportstrom should there be any loss of data – regardless of the cause and by whom it is caused.
Sportstrom will care for your integrity and will not share your personal information (such as IP number, names, date of birth, etc) with any third party other than if it is pursuit of a joint activity with the Police as described in section 4 above, or if you yourself have posted such information as public information under your profile.
Sportstrom does not sell personal details about any members or profiles to third party.
Sportstrom will receive reports and encourage you to report any inappropriate content as per the description in section 4 above. In is Sportstrom’s intention and ambition to attend to all such reports. If you write a report it is important that you are specific about what has happened, the details about the profile and the particular inappropriate content. All content published on Sportstrom will be stored (including deleted content) and Sportstrom will endeavor to do its best to satisfy members submitting reports.
Sportstrom is and shall remain the sole owner to the Sportstrom site and all its sub pages (including your profile page), underlying infrastructure, program code, ideas, logos, and with the site associated material (except for content uploaded by members). You hereby agree that you do not have rights to claim any ownership to any of the described Sportstrom properties.
Sportstrom may decide at its own discretion to prioritize and reserve certain famous user names for “famous” profiles. Such prioritization and reservation may occur retroactively upon which Sportstrom will contact you first to inform you that your profile name will be changed.
7.Miscellaneous
Sportstrom reserves the right to at its sole discretion change the terms laid out in this document. It is your responsibility to revisit these terms and to ensure you are aware of the terms in effect. Your usage of Sportstrom shall always be considered as an agreement and acceptance of the terms valid at that point.
The terms, conditions, and right granted to and agreed to by you in this document cannot be transferred by you to any other third party whereas the terms and conditions granted to Sportstrom can at Sportstrom’s sole discretion be transferred from Sportstrom to another third party.
This agreement is valid and in effect from the moment you mark the checkbox that you accept Sportstrom terms and conditions and will then stay in effect as long as your profile is commissioned with Sportstrom, except for the rules defined in section 3 (responsibility for content) which shall continue to apply indefinitely.
In the event that you and Sportstrom enter into any civil suit, that should be settled in Sweden under Swedish law.
In the event that a section or clause in this agreement should found invalid by law, the remainder of the agreement shall stay in affect without influence from the interpretation of the invalid clause.
